1. Acceptance of Terms

Welcome to Cholesterol Heart Tracker ("the App"). By downloading, installing, or using the App, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Heart Tracker ("we," "us," or "our"). We reserve the right to update these Terms at any time. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

2. Description of Service

Cholesterol Heart Tracker is a health and wellness application that provides:

• Food and meal logging with nutrition tracking
• Cholesterol test result tracking and trend analysis
• Integration with Apple Health for activity and health data
• AI-powered voice meal entry and health insights
• Recipe creation and sharing capabilities
• Personalized dietary recommendations

The App is designed to help users track their diet and cholesterol levels for informational and educational purposes only.

3. Medical Disclaimer

The App and its content are provided for informational purposes only and are not intended to:

• Diagnose, treat, cure, or prevent any disease or medical condition
• Replace professional medical advice, diagnosis, or treatment
• Serve as a substitute for consultation with qualified healthcare professionals
• Provide medical recommendations or clinical advice

Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition or cholesterol management. Never disregard professional medical advice or delay seeking it because of information provided by the App.

If you think you may have a medical emergency, call your doctor or emergency services immediately.

4. User Responsibilities

4.1 Accurate information

You are responsible for entering accurate information into the App, including but not limited to:

• Meal and food logs
• Cholesterol test results
• Personal health information
• Activity and exercise data

We are not responsible for any consequences resulting from inaccurate or incomplete data entry.

4.2 Data verification

While we strive to provide accurate nutritional information from our food database, you should verify critical information, especially if you have allergies, dietary restrictions, or specific health conditions. Nutritional data is provided by third-party sources and may contain errors.

4.3 Age requirements

You must be at least 13 years old to use the App. If you are under 18, you must have parental or guardian consent to use the App.

4.4 Prohibited uses

You agree not to:

• Use the App for any illegal purpose or in violation of any laws
• Attempt to reverse engineer, decompile, or disassemble the App
• Use automated systems to access or scrape data from the App
• Share or distribute content in a way that violates others' privacy or rights
• Upload malicious code or attempt to compromise the App's security
• Misrepresent your identity or affiliation

5. Intellectual Property

5.1 Our rights

The App and all its content, features, and functionality (including but not limited to software, code, design, graphics, and user interface) are owned by us and are protected by copyright, trademark, and other intellectual property laws.

5.2 Your license

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. This license does not include:

• Resale or commercial use of the App or its contents
• Collection and use of product listings or descriptions
• Derivative use of the App or its contents
• Any downloading or copying of account information

5.3 Your content

You retain ownership of any content you create within the App (recipes, custom foods, meal logs). However, by using sharing features, you grant recipients a license to use the shared content.

6. Third-Party Services

6.1 Apple Health integration

The App integrates with Apple Health. Your use of Apple Health is subject to Apple's terms and conditions. We are not responsible for Apple Health's functionality or data handling.

6.2 Food database API

Nutritional information is provided by third-party food databases. We make no guarantees about the accuracy, completeness, or reliability of this information.

6.3 Advertising

The App displays advertisements through Google AdMob. Your interaction with ads is subject to Google's terms and privacy policies. We are not responsible for the content of third-party advertisements.

7. Disclaimers and Limitations of Liability

7.1 No warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy, reliability, or completeness of content

We do not warrant that the App will be uninterrupted, error-free, secure, or free from viruses or other harmful components.

7.2 Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Personal injury or property damage
• Health-related consequences resulting from use of the App

Our total liability to you for any claims arising from your use of the App shall not exceed the amount you paid to us in the twelve (12) months prior to the claim (if any).

7.3 Health outcomes

We make no guarantees about health outcomes from using the App. Results vary by individual, and the App's recommendations should not replace professional medical guidance.

8. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

Key points:

• All health data is stored locally on your device
• We do not collect or store your personal health information on our servers
• You are responsible for backing up your data
• Deleting the App will delete all local data

9. Updates and Modifications

9.1 App updates

We may release updates to the App from time to time. These updates may include new features, bug fixes, or performance improvements. You are responsible for updating the App to the latest version.

9.2 Changes to terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date. Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.

9.3 Service changes

We reserve the right to modify, suspend, or discontinue any feature of the App at any time without notice or liability.

10. Termination

You may stop using the App at any time by deleting it from your device. We reserve the right to terminate or suspend your access to the App at any time, with or without cause or notice, for any reason including violation of these Terms.

Upon termination:

• Your license to use the App will immediately cease
• You must delete the App from your device
• All locally stored data will be deleted upon app removal

11. Indemnification

You agree to indemnify, defend, and hold harmless Heart Tracker, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations

12. Governing Law and Disputes

12.1 Governing law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

12.2 Dispute resolution

Any disputes arising out of or relating to these Terms or the App shall first be attempted to be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

12.3 Class action waiver

You agree that any arbitration or proceeding shall be limited to the dispute between you and us individually. You waive any right to participate in a class action lawsuit or class-wide arbitration.

13. Miscellaneous

13.1 Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior agreements and understandings.

13.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

13.4 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.

13.5 Force majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, network failures, or government actions.
